Please read these Terms of Service ("Terms") carefully before using the Nagg AI mobile application ("the App") operated by Yang-Che Hsiao ("we," "us," or "our").
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.
Nagg AI is a smart alarm application that allows users to create personalized alarm messages using text-to-speech technology. The App converts user-provided text into voice audio that plays as alarm sounds.
To use certain features of the App, you must create an account using Sign in with Apple. You are responsible for maintaining the security of your Apple ID and for all activities that occur under your account. You agree to provide accurate information when creating your account and to update your information as necessary.
The App offers subscription-based premium features. Subscriptions are processed through Apple's App Store and managed via RevenueCat. By subscribing, you agree to pay the applicable fees as displayed at the time of purchase.
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription through your Apple ID account settings. Refunds are handled according to Apple's App Store policies.
You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to use the App to create, upload, or transmit any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable. You also agree not to attempt to interfere with or disrupt the App's servers or networks, impersonate any person or entity, or use the App for any commercial purpose without our prior written consent.
You retain ownership of the text content you input into the App. By using the App, you grant us a limited, non-exclusive license to process your text content solely for the purpose of generating voice audio for your alarms.
You are solely responsible for the content you create and must ensure it does not violate any third-party rights or applicable laws. We reserve the right to remove any content that violates these Terms.
The App, including its design, features, code, and branding, is owned by us and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App, nor may you reverse engineer or attempt to extract the source code of the App.
The App uses the following third-party services:
Your use of these services is subject to their respective terms and policies. We are not responsible for the practices or content of these third-party services.
The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
The App is designed to assist with waking up, but we make no guarantees that alarms will function perfectly in all circumstances. You should not rely solely on the App for critical wake-up situations.
To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the App. Our total liability for any claims arising from your use of the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of a third party.
We may terminate or suspend your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App will immediately cease. You may also delete your account at any time by contacting us.
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the App after any changes indicates your acceptance of the updated Terms.
These Terms shall be governed by and construed in accordance with the laws of Taiwan (Republic of China), without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts located in Taiwan.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede all prior agreements and understandings.
